This page describes how the app is managed with regard to the processing of personal data of its users.
This information is also provided pursuant to art. 13 of the European Regulation (EU) 2016/679 (hereinafter GDPR) . All features, settings and processing flows are designed according to the principles of data protection by design and by default , in accordance with the GDPR, with the Data Act (EU Reg. 2023/2854
The information for the collection of personal data illustrates, for the sake of transparency, the methods, timing, and nature of the information that data controllers must provide to users when they connect to the following app, regardless of the purpose of the connection.
DATA CONTROLLER
The data controller is V2 SpA – Corso Principi di Piemonte, 65/67 12035 – Racconigi ( Italy ).
PURPOSE OF DATA PROCESSING
User Data is collected to allow the Owner to provide its services, as well as for the following purposes:
DATA TYPES
- User identification and registration data. Required to create and manage your account are: first and last name; email address; password; country of residence and language; account and user ID; and any data resulting from multi-factor authentication.
- Device technical data. This is the technical data generated by the device during normal operation: event log (operating status, on/off, temperature and battery), operational events and actions (modify , delete images), automation list, and schedule list (timers, time slots).
(This data may be accessible to the User pursuant to Articles 4–5 of the Data Act, within the limits of the product’s functionality and the technical specifications indicated in the manuals.) - Connection metadata. Collected automatically to ensure the secure and stable operation of the platform: IP address, access timestamp , operating system,
- Geolocation data . Collected only if the User activates the feature on their mobile device: real-time GPS location; estimated location via Wi-Fi or Bluetooth networks; proximity data for automation functions.
LEGAL BASIS
Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract (Article 6, paragraph 1, letter b), of the European General Data Protection Regulation 2016/679 (GDPR), the legitimate interest of the data controller (Article 6.1.f), and consent in the case of purposes c), d), and by legal obligation for the purposes under letter f).
RETENTION PERIOD
The data will be retained for 5 years plus any legal obligations and disputes. Metadata will be retained for 24 months .
MANDATORY OR OPTIONAL NATURE OF DATA PROVISION
Please note that, given the purposes of processing as described above ( a and b ), the provision of data is mandatory and failure to provide it, or its partial or incorrect provision, may result in the inability to respond to requests made or to use the services. For purposes (c and d) , the provision of data is optional and the consent given may be revoked at any time.
DATA PROVIDED VOLUNTARILY BY THE USER
The optional, explicit, and voluntary sending of emails to the addresses indicated on this app entails the subsequent acquisition of the sender’s address, which is necessary to respond to requests, as well as any other personal data included in the message.
RECIPIENTS OR CATEGORIES OF RECIPIENTS
Personal data will be processed by the Data Controller and by persons strictly authorized by him:
- Authorized employees and collaborators of V2, limited to their duties;
- Authorized installers and maintenance workers;
- Cloud and IT service providers Duly appointed as data controllers pursuant to art. 28;
- Competent authorities and bodies, when required by law or by a judicial order;
The data will not be disclosed.
RIGHT TO LODGE A COMPLAINT WITH THE SUPERVISORY AUTHORITY
The data subject has the right to lodge a complaint with the Supervisory Authority (For Italy: Garante per la protezione dei dati personali www.garanteprivacy.it ).
DATA SUBJECT RIGHTS
You may exercise your rights to access, rectify, or erase your personal data, restrict processing, object to processing, and data portability (as per Articles 15-20 of European Regulation 679/2016) at any time by sending an email to privacy@ableautomation.com .
RIGHT TO OBJECT
You may, at any time, exercise your right to object, for reasons related to your particular situation, to the processing of your personal data pursuant to Article 6, paragraph 1, letters e) or f) of the GDPR. With regard to the processing of personal data for direct marketing purposes , you have the right to object at any time to the processing of your personal data for such purposes by sending an email request. privacy@ableautomation.com .
RIGHT TO WITHDRAW CONSENT
The data subject has the right to withdraw his or her consent at any time by sending an email to privacy@ableautomation.com ; such withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.
EXISTENCE OF AN AUTOMATED DECISION-MAKING PROCESS
The processing does not involve automated decision-making.
TRANSFER OF DATA TO A THIRD COUNTRY OR TO AN INTERNATIONAL ORGANIZATION
The Data Controller will not transfer personal data to a third country or to an international organization.
PERSONAL DATA AND PRIVACY – INDEMNIFICATION
You are responsible for all data and content uploaded by you or on your behalf to the App.
The account registration data will be saved in the Owner’s databases.
You are responsible for any activity and/or information conducted and entered through your account.
You may not impersonate anyone else or provide inaccurate information.
You may not act in an unlawful, deceptive or fraudulent manner or for any purpose contrary to the law.
The Owner is exempt from any responsibility regarding the information entered by the User on his/her account.
